Invoices / Terms and Services Agreements

This session was really useful to start thinking and learning about the more technical legal stuff involved with being a freelance designer. This is the sort of thing that would never really occur to you to learn until the point you actually need it, so it was really helpful to get some insight on it now.

Here is a list of things that should be included in a simple terms and services agreement:

- schedule parameters
  • schedule or timeline
  • Client responsibilities
  • Client representative
  • Client approvals
  • Client changes
  • Samples and credit
  • Payment parameters
  • Delays and termination
  • Consequences of non payment
  • Media
  • Duration
  • Location
  • Electronic files
  • Length of storage
  • Retrieval fee
  • File requirements

10 things every creative should know (according to a lawyer)

  • know the value of your work
  • Protect your work and your brand
  • Know your client and what they want
  • Who owns your work?
  • NDA - non disclosure agreement
  • Don’t agree to something without reading it. Even the small print.
  • Consultant, contractor, employee, worker - which are you?
  • What to do if someone steals your ideas or designs
  • Get to know a friendly lawyer
